4.3. Describe the potential tension between maintaining an individual’s confidentiality and disclosing concerns
As part of the Level 3 Diploma in Care RQF, it is necessary to understand how to balance an individual’s confidentiality with concerns about disclosure. This tension has its roots in deep-seated ethics and legal duties of care professionals related to handling sensitive information.
1. Understanding Confidentiality and Disclosure
Confidentiality is the boundary set within care settings that ensures protection of any personal information that a person may reveal. This makes the patients develop trust with the carers, thus freeing them to communicate openly and freely. Sharing concerns may result in tension with the need to maintain confidentiality in some circumstances, particularly where there is a risk to a service user or others.
2. Balancing Potential Tension Between Confidentiality and Sharing Concerns
The essence of the conflict lies between maintaining privacy versus safety. There are many instances where professionals in care face the position to make a decision whether to disclose information to safeguard an individual from any kind of harm or severe issues. For example, if a care worker suspects abuse or neglect, there arises a dilemma between the duty of confidentiality to the service user versus the requirement for reporting information to appropriate authorities.
3. Legal and Ethical Considerations
This balance is overseen by several legal and ethical frameworks. The Data Protection Act 2018 and GDPR emphasize that personal data should be treated confidentially but allow for disclosure in specified situations, for example, safeguarding or requirement of the law. The Care Act 2014 promotes the sharing of information to ensure the safety and well-being of all concerned.
Ethically, a professional has to balance the beneficence principle, which is directed toward doing what is best for a person. It might involve breaching confidentiality in circumstances where the breach of confidence is likely to avoid severe harm either to the person or someone else. On the other hand, upholding principles of autonomy and confidentiality is fundamental to respecting the rights of all persons and to establishing a relationship of trust.
4. Balancing Confidentiality and Disclosure
Effective communication is thus required to tread this tension. Professionals should clearly define and explain the boundaries of confidentiality to the person and when it may be necessary to reveal the information. This kind of transparency will hence provide room for expectation management, making a person aware of his or her rights and possibilities of information disclosure.
Also, there have to be clear policies and procedures about sharing information. It consists of the professional’s role, their responsibilities in the organization, and legally related requirements for reporting certain concerns.
5. Approaches to dealing with Tension
The following are some of the approaches professionals can use in dealing effectively with tension:
Clear Policies: Development and adherence to organizational policies describing when and how the information will be shared.
Training and Supervision: Engage in training and supervision regularly to be updated regarding the legal and environment of best practices for keeping sensitive information confidential.
Consultation: In case of doubt regarding whether or not the information should be disclosed, consult with supervisors or legal counsel.
Documenting Decisions: Proper documentation of the decisions made to disclose or not to disclose and, in case of disclosure, why it should be done.
6. Consequences of Breaching or Upholding Confidentiality
Breaking confidentiality without a just cause will lead to loss of trust and deterioration in the well-being of the person; it can also lead to legal consequences. On the other hand, sharing important information for a need may compromise safety and defeats the end of care. Both actions may influence the care delivered with power and impress upon the professional’s integrity.
